Kant nimmt in der Einleitung zur Metaphysik der Sitten eine Einteilung in innere und äußere Gesetzgebung vor. Beide leitet er aus demselben in der Grundlegung zur Metaphysik der Sitten formulierten kategorischen Imperativ ab, und fügt Letzterem weitere Elemente einer Grundanthropologie hinzu, die das Material für die einzelnen Teile der Rechts- und Tugendlehre darstellen. Die Zusammenhänge zwischen Rechts- und Tugendlehre sind aber komplexer als die Einteilung in äußere und innere Gesetzgebung es nahelegt. Sie teilen etwa dieselben Anwendungsmethoden und Metaphern, und bei (...) einer näheren Untersuchung der einzelnen Teile erweist sich diese Einteilung als entweder problematisch oder unscharf. In der Textinterpretation der einzelnen Beiträge kommen die genannten Zusammenhänge und Beziehungen zum Vorschein – insbesondere weil ein Teil der Autoren dieses Bandes zum Kommentar beider Werken beiträgt. Ein weiterer Schwerpunkt dieser Textinterpretationen liegt bei der kritischen Untersuchung des Ertrags dieser Werke für die entsprechenden heutigen Debatten und die Auseinandersetzung mit heutigen im weiten Sinne „Kantischen“ Positionen. In diesem Beitrag werden die Fragen diskutiert: Welche Vorstellungen von Geschlecht und Sexualität finden sich im Buddhismus, welche Frauenrollen oder Frauenbilder lassen sich daraus ableiten, und was geschieht, wenn diese Geschlechtervorstellungen heute auf den europäischen Kontext treffen: Welche Probleme entstehen? Ist Geschlechtergerechtigkeit ein westliches Problem oder wird sie weltweit thematisiert? Lassen sich Wechselwirkungen feststellen, und welche Strategien werden verfolgt, um Geschlechtergerechtigkeit im Buddhismus herzustellen?

Background: Engaging in end-of-life care considerations is beneficial when the time is right. The purpose of this study is to provide a valid instrument to assess peoples readiness for end-of-life conversations before they are initiated.Materials and Methods: A community sample was recruited in study one for exploratory factor analysis of a 13-item questionnaire. In study two, psychometric properties were analyzed with structural equation modeling in a population affected by cancer. Convergent and discriminant validity were assessed with questionnaires measuring distress, depression, (...) anxiety, fear of progression, and distress of death and dying.Results: In study one exploratory factor analysis resulted in three subscales readiness, communication, and values with a possible common factor for a community sample. In study two the three-factor solution with 13 items was not supported for cancer patients. Factor structure was adapted to 12 items with one common factor readiness. Model fit was good: χ2 = 59.18, p>0.05, with χ2/df = 1.184, rRMSEA = 0.053, and rSRMR = 0.072. Convergent validity was supported by moderate correlations to trait gratitude, ratings of readiness to provide a living will or talk with family about the end of life. Divergent validity was supported by no or small correlation with distress, depression, general and death anxiety and fear of progression, respectively.Conclusions: Results support usage of the REOLC Scale in different settings with adapted factor structure. The questionnaire is interpreted as valid and reliable instrument to assess objective readiness for end-of-life conversations. (shrink)

BackgroundBiobanking biospecimens and consent are common practice in paediatric research. We need to explore children and young people’s (CYP) knowledge and perspectives around the use of and consent to biobanking. This will ensure meaningful informed consent can be obtained and improve current consent procedures.MethodsWe designed a survey, in co-production with CYP, collecting demographic data, views on biobanking, and consent using three scenarios: 1) prospective consent, 2) deferred consent, and 3) reconsent and assent at age of capacity. The survey was disseminated (...) via the Young Person’s Advisory Group North England (YPAGne) and participating CYP’s secondary schools. Data were analysed using a qualitative thematic approach by three independent reviewers (including CYP) to identify common themes. Data triangulation occurred independently by a fourth reviewer.ResultsOne hundred two CYP completed the survey. Most were between 16–18 years (63.7%, N = 65) and female (66.7%, N = 68). 72.3% had no prior knowledge of biobanking (N = 73).Acceptability of prospective consent for biobanking was high (91.2%, N = 93) with common themes: ‘altruism’, ‘potential benefits outweigh individual risk’, 'frugality', and ‘(in)convenience’.Deferred consent was also deemed acceptable in the large majority (84.3%, N = 86), with common themes: ‘altruism’, ‘body integrity’ and ‘sample frugality’. 76.5% preferred to reconsent when cognitively mature enough to give assent (N = 78), even if parental consent was previously in place. 79.2% wanted to be informed if their biobanked biospecimen is reused (N = 80).ConclusionProspective and deferred consent acceptability for biobanking is high among CYP in the UK. Altruism, frugality, body integrity, and privacy are the most important themes. Clear communication and justification are paramount to obtain consent. Any CYP with capacity should be part of the consenting procedure, if possible. (shrink)

Zusammenfassung Patientinnen und Patienten steht das Recht auf Behandlung nach ihren eigenen Vorstellungen auch dann zu, wenn sie aktuell keinen eigenen Willen bilden können. Advance Care Planning (ACP), als ein spezielles Verfahren der gesundheitlichen Vorsorgeplanung, zielt darauf ab, dieses Dilemma durch eine Willensbestimmung im Voraus aufzulösen. Besonders ausgebildete Gesprächsbegleiter*innen bieten an, bei der Ermittlung, Formulierung und Dokumentation eines solchen, die individuelle gesundheitliche Situation berücksichtigenden Willens zu helfen. Das Umfeld der Betroffenen soll in den Gesprächsprozess einbezogen und es soll organisatorisch gesichert (...) werden, dass deren Willensbestimmung den aktuell Behandelnden im Bedarfsfall faktisch zugänglich ist. Das Verfahren kombiniert also ein kommunikatives mit einem institutionellen Element. Aus ethischer Sicht stellen sich dabei zwei wesentliche Herausforderungen. Erstens erfordert Gesprächsbegleitung mit einem so komplexen Ziel Kompetenzen und setzt bestimmte Haltungen voraus, wie sie für Professionen im strengen Sinne typisch sind. Daher wäre es wichtig, entsprechende professionelle Normen explizit zu machen, beispielsweise in Form eines Berufs-Kodex. Zweitens muss das Verfahren trotz seiner institutionellen Form für die Betroffenen freiwillig sein. Dies ist entscheidend für die Validität des Prozesses, aber auch für dessen Ergebnis. Denn wenn Letzteres rechtlich bindend sein soll, müssen die Betroffenen freiverantwortlich, d. h. ohne sog. Willensmängel handeln können. Es ist deshalb ethische Pflicht, beim Eintritt in und im Verlauf der Beratung auf die Freiwilligkeit zu achten. (shrink)

Simulationen mit Simulationspersonen gehören in der medizinischen Lehre zum Ausbildungs-Standard. In der medizinethischen Lehre ist dies bisher nicht in gleichem Umfang der Fall. Für ihren Einsatz, insbesondere in der klinischen Ethik, können gute Gründe angeführt werden, wie beispielsweise die Möglichkeit konkreter Erfahrungen als Lehrelement und die situationsspezifische Verbindung von Wissen, Können und Haltungen in einem Lernprozess. Die Konzeption von Simulationen mit Simulationspersonen in der medizinethischen Lehre ist jedoch voraussetzungsreich. Es müssen die mehrdimensionalen Lernziele und die Anforderungen an die medizinethische Lehre (...) berücksichtigt werden. Der Beitrag möchte anhand eines konkreten Beispiels einen Überblick über die Entwicklung und Konzeption von Drehbüchern bzw. Rollen-Skripten für Simulationen mit Simulationspersonen für die Lehre in der klinischen Ethik als wichtigem Teilbereich der Medizinethik geben. Dabei wird auf die besonderen Voraussetzungen und Spezifika dieser Simulationen eingegangen. Abschließend wird kritisch diskutiert, welchen Stellenwert das Training von kommunikativen Fertigkeiten in der medizinethischen Theorie und klinisch-ethischen Praxis haben kann und soll. Der Beitrag schließt mit der Überlegung, ob nicht auch in der Fortbildung von klinischen Ethiker*innen Simulationspersonen zum Einsatz kommen sollten. (shrink)

Seit über zehn Jahren moderieren die Autor*innen mit hohem Zuspruch das Ethik-Café in Einrichtungen des Sozial- und Gesundheitswesens. Menschen aus unterschiedlichen Berufen, Patient*innen, An- und Zugehörige sowie ethisch Interessierte haben im Ethik-Café die Möglichkeit, aus ihrer persönlichen und beruflichen Perspektive ethische Fragestellungen zu diskutieren, die für ihren Alltag relevant sind. Ethik-Cafés sind niederschwellig, multiprofessionell, interdisziplinär. Die Teilnehmer*innen profitieren von dieser Perspektivenvielfalt. Das Buch stellt die Konzeption sowie deren Evaluation, die theoretischen und methodischen Voraussetzungen und in vielen Beispielen die praktische Umsetzung (...) von Ethik-Cafés dar. Das entwickelte Vier-Phasen-Modell des ethischen Prozesses wird exemplarisch in 25 Ethik-Cafés zu Themen aus dem Sozial- und Gesundheitswesen angewendet und umgesetzt. Das Buch richtet sich an Mitarbeiter*innen und Führungskräfte im Sozial- und Gesundheitswesen, Lehrer*innen, Lernbegleiter*innen und Auszubildende in der generalistischen Pflegeausbildung, an Fort- und Weiterbildungsreferent*innen, Studierende, Ehrenamtliche sowie alle ethisch Interessierten. ABSTRACTHow accurate are insights compared to analytical solutions? In four experiments, we investigated how participants' solving strategies influenced their solution accuracies across different types of problems, including one that was linguistic, one that was visual and two that were mixed visual-linguistic. In each experiment, participants' self-judged insight solutions were, on average, more accurate than their analytic ones. We hypothesised that insight solutions have superior accuracy because they emerge into consciousness in an all-or-nothing fashion when the unconscious solving process is complete, (...) whereas analytic solutions can be guesses based on conscious, prematurely terminated, processing. This hypothesis is supported by the finding that participants' analytic solutions included relatively more incorrect responses than timeouts compared to their insight responses. (shrink)

La inmunización en adultos es una estrategia de salud pública que se ha desarrollado e impulsado en los últimos años como consecuencia del envejecimiento poblacional. El aumento de la proporción de personas adultas en la población y la manifiesta preocupación por promover un envejecimiento saludable de la población plantean la premura de aportar evidencia científica sobre los factores que se asocian a la vacunación de adultos. La prevalencia de inmunizaciones en adultos está por debajo de las metas planteadas por el (...) Ministerio de Salud, por ello se propone como objetivo explorar e identificar los factores asociados a la vacunación de adultos en Argentina, teniendo en cuenta las recomendaciones del calendario nacional de inmunizaciones. Se trata de un estudio cuantitativo, exploratorio y correlacional, cuya fuente de datos es la Encuesta Nacional de Factores de Riesgo de 2013. En la metodología se desarrollan modelos logísticos individuales usando como variables explicativas sexo, nivel de instrucción, cobertura de salud, situación conyugal y si accedió a información sobre vacunas de adultos en algún medio masivo de comunicación. La unidad de análisis son las personas mayores de 18 años y se analizan las subpoblaciones objetivo de las siguientes vacunas: doble bacteriana o triple acelular del adulto, influenza y neumococo. Como contribución puede mencionarse que los resultados indican que haber visto o escuchado información sobre vacunas de adultos resultó el factor que más aumenta las probabilidades de estar inmunizados de los adultos argentinos. This essay is a critical discussion of Dipesh Chakrabarty’s book Provincializing Europe as well as a first sketch of a History on Equal Terms. After giving a short summary of Provincializing Europe, I first argue, against Chakrabarty, that there is no necessary connection between the discipline of history and the metanarratives of modernity. To the contrary: the founding idea of the discipline of history was a turn against such grand narratives. With his attempt to deconstruct the narratives of the European (...) Enlightenment and of modernity, Chakrabarty therefore has to be regarded as a thinker of radical historicism rather than as a critic of the discipline of history. Second, I criticize the use of the term “modernity” in Provincializing Europe and the concept of modernity in general. Instead of a deconstruction of the discipline of history, I propose a deconstruction of the concept of modernity. This could open up the way for a History on Equal Terms situated within the discipline of history, that is, a historiography that would—just as Chakrabarty rightly demands—in principle pay the same attention to and expect relevant results from any region in the world, depending only on the focus of research. This article is based on narrative, autobiographic interviews with domestic workers in Peru focusing on their migration and work experiences. The interviewees evoke a border discourse that divides and hierarchizes Peruvian society and stigmatizes migrants, especially migrant domestic workers. As domestic service leads to intense social interactions at this ‘border’, the interviewees are constantly forced to ‘translate’ when constructing their identity. The discourse-analytical bottom—up perspective focusing on membership categorization devices evaluates the performativity of the discourses of those considered as ‘oppressed’; (...) it analyses processes of subjection and subjectification: whereas some of the interviewees internalize the discursively attributed inferior ‘Me’, others use the constructed borders as an opportunity to develop hybrid discourse strategies that cross and even deconstruct social categorizations. By focusing on the agency of ‘border-crossers’, the article aims at scientifically ‘rethinking the social with cultural difference as a constitutive feature’. (shrink)

The aim of this study was to explore the meaning of experience for home‐care nurses in a multicultural area of Sweden. Interviews and group discussions with a team of five home‐care nurses were interpreted in accordance with a hermeneutical perspective. The meaning was expressed in connection with the complexities of place, and space for care. Contradictions developed from diversities of perspectives incorporated in this particular multicultural area. Nurses saw themselves as mediators and allowed complexity to be considered in order to (...) manage care. They took on responsibility of creating a ‘space of care’, while the organizational structures of home care were perceived as something outside the care praxis. Making contradictions evident renders an intermediary caring strategy feasible. (shrink)

The purpose of this article is to discuss narration of ethical themes in nursing care. The text represents part of the findings of an ethnographic study aimed at description of everyday work on an oncology ward. Nurses on this ward are constantly involved in ethical care issues and narratives are told to share experiences. Of vital importance in ethical decision making is the perpetual creation of a mediating moral world constituted by daily experience. The need for making space in nursing (...) for a continual learning conversation is expressed and in this I include writings of nursing theorists. (shrink)

Motivated by the ongoing controversy surrounding corporate tax, this article presents a study that explores stakeholder expectations of corporate tax in the context of UK business. We conduct a qualitative analysis of in-depth interviews with representatives of community groups, as well as interviews with those representing business groups. We then identify eight themes that together describe “what” companies need to do, “how” they need to do it, and “why” they need to do it, if they wish to appeal to a (...) wide group of interested parties. We discuss our findings based on the corporate social responsibility literature and propose novel ways for community groups and business groups to connect on the topic of corporate tax, suggesting opportunities and themes for dialogue and potential steps to co-create solutions in a stakeholder society. This essay deals with some philosophical problems concerning the understanding of ethical conceptions in an alien culture. Its aim is to show that in investigating such conceptions we cannot proceed on purely empirical grounds; our own ethical concepts will, in a conceptual sense, determine what it is conceivable that we find.

In response to the IABS conference theme to “advise practitioners,” this paper is framed in terms of two questions that have been found to be critical to practitioners. These are “what is Corporate Responsibility and how to do it” and “what is the value of Corporate Responsibility.” The paper uses theories from within the academic literature to develop a model to answer these two practitioner-based questions. Una forma frecuente de medir y estimular el desarrollo narrativo infantil utiliza el recontado de una narración. En Chile, se han diseñado tareas considerando la estructura del input verbal, tanto en un nivel léxico-sintáctico como textual, estableciéndose –incluso– niveles de complejidad. En el marco del Proyecto FONDECYT 1130420, para elaborar un cuento infantil –input de la tarea de recontado– se hizo hincapié no solo en los rasgos verbales, sino también visuales del relato. De tal forma, se propuso un doble objetivo: (...) diseñar las imágenes de una historia potenciando su significado a través de una gramática visual y observar en qué medida estos elementos aparecen reflejados en el recontado oral de los sujetos. Para este propósito, junto a la Gramática de la Historia para el discurso, se consideró la Gramática de Diseño Visual y sus herramientas analíticas para la construcción de imágenes. El cuento se piloteó en una muestra de 20 pre-escolares de Kinder de un colegio particular subvencionado de la Región de Valparaíso. Sus discursos fueron videograbados, transcritos y analizados. Se observó que todas las imágenes narrativas aparecen mencionadas en más de un 60% de los recontados. Además, existen tres referidas en el 90% de los discursos infantiles y representan momentos cruciales del relato o cierta complejidad del input como la simultaneidad de acciones. Estos resultados permiten valorar la importancia de los elementos visuales del cuento en la tarea de recontado infantil. (shrink)

What will be postulated here, is that the concept of precaution and his Principle, it continues being a determination of the technology, not only a consummation of the instrumental and anthropologic action, but a consummation of the ‘technical’ of the thought. Drawing on corpora from West Africa and Iceland, the article presents a fieldwork-based comparative exploration of ‘things that place names do’. Treating toponyms as performative elements of culture, we have observed striking parallels as well as differences in the uses of place names in both regions. Place names communicate spatial orientation; play an important role in the commemoration of people and events; mark claims of possession; support the construction of identity; sacralize landscapes; and voice moral reprimands. They can provide entertainment, (...) by, for instance, inscribing ridicule into the land. They subvert as well as affirm hierarchies and power structures, and even play a role in interethnic conflict. Equally, they can become nuclei of storytelling, providing starting points for the invention of narratives. Showing the range of functions that place names can assume in two very different geographical contexts, the article presents a heuristic illustration of the potential of fieldwork-based approaches for toponomastic research.
